New Acting Attorney General Dana Boente Set for Brief Tenure
The United States acting attorney general — for the next few days, at least — is a little-known, but longstanding federal prosecutor.
Dana Boente, the US attorney for the Eastern District of Virginia, was sworn in as acting attorney general at 9 p.m. Monday evening after President Donald Trump fired the former acting head, Sally Yates, for her unwillingness to defend the administration’s executive action on immigration. A few hours later, Boente issued a statement rescinding Yates’ order, instructing DOJ lawyers to “defend the lawful orders of our President.”
Boente’s tenure as the head of the Justice Department will only last a few days, pending attorney general nominee Jeff Sessions’ approval by the Senate. But Boente has instantly been thrown into the winds of a revealing political storm just 10 days into his presidency.
Boente has served the Justice Department for 31 years, according to his official biography, and has been the permanent US attorney for the Virginia court since December 2015. He served in the same role from October 2008 to September 2009, and as the US attorney for the Eastern District of Louisiana from December 2012 to September 2013, at which point he was appointed to the acting US attorney role back in Virginia.
“I am honored to serve President Trump in this role until Senator Sessions is confirmed,” Boente said in a statement produced by the White House in announcing the appointment. “I will defend and enforce the laws of our country to ensure that our people and our nation are protected.”
Boente’s most prominent recent case was leading the corruption trial of former Virginia Gov. Bob McDonnell, whose conviction was overturned by the Supreme Court last year. Boente declined this past September to retry the case.
“This investigation, prosecution and sentence will help restore and maintain the high integrity of the governor’s office,” Boente said in January 2015 when McDonnell was sentenced, “while affirming our commitment to prosecuting public officials who commit crimes.”

New Jersey Woman Accused of Throwing 5-Year-Old Girl in Front of Moving Train

The family of a woman accused of throwing a 5-year-old girl in front of a moving train on Friday says she has “mental health issues,” NJ.com reports.
Autumn Matacchiera, 20, is charged with attempted murder following the incident, which happened on a New Jersey Transit light rail platform.
Around 8:30 p.m. that evening, an NJ Transit bus driver flagged down a police officer to report that Matacchiera was acting “suspiciously.” As officers arrived at the train platform, Matacchiera allegedly grabbed the unsuspecting young girl as she stood next to her mother and threw her onto the tracks as a train was approaching.
Officers were able to jump onto the tracks and signal for the train to stop so the mother’s boyfriend could pull the girl to safety. Matacchiera was arrested and taken into custody.
“She is not a criminal,” Autumn’s mother, Laura Matacchiera, told NJ.com. “She has mental health issues. It’s an ongoing problem,” she said, adding that her daughter had resided in multiple mental health facilities — but has been repeatedly released despite objections from family.
Meanwhile, the girl was taken to a hospital with a cut to her face and bruising.
Police said Matacchiera did not know the girl she attacked.

Bus Driver Sentenced to 2 Years in Prison for Death of 19-Year-Old Special Needs Student Left on Parked School Bus in Whittier
A school bus driver was sentenced Monday to two years in prison for the death of a 19-year-old special needs student who was left on a parked school bus for several hours on a hot summer day, the Los Angeles County District Attorney’s Office reported.
Armando Abel Ramirez, 37, of Rialto, pleaded guilty to one felony count of dependent adult abuse resulting in the death of Hun Jun “Paul” Lee on Jan. 6, 2017, the District Attorney’s Office reported.
Lee, a Sierra Adult School student, was found laying on the floor of the parked bus on Sept. 11, 2015. All of the windows were closed and the temperature was 96 degrees the day he died on the school bus, prosecutors said.
An investigation into Lee’s death revealed the teenager could not communicate verbally and needed special care.
On the day of Lee’s death, Ramirez was a substitute driver for Lee’s bus and was working a split shift, prosecutors said.
Ramirez told authorities he believed Lee had gotten off the bus to go to school in the morning, but prosecutors said Ramirez did not walk to the back of the bus to check and did not look over his shoulder to make sure no one was left in the bus before the end of his morning shift.
Ramirez parked the bus in the yard and left. When he returned hours later for the second part of his shift, Ramirez was notified by a dispatcher that Lee was missing.
Ramirez went to his bus and at that point found Lee unresponsive inside and called for help.
The case was investigated by the Whittier Police Department.

Debris Flow Affecting 3 Homes in Hollywood Hills; Firefighters Responding: LAFD
Los Angeles firefighters were responding Monday evening to Hollywood Hills homes at the entrance to Laurel Canyon after debris flow apparently came downhill toward the residences.
Aerial video from Sky5 showed fire engines responding to homes on Laurel View Drive, which sits above Laurel Canyon Boulevard at Hollywood Boulevard. Firefighters were shining flashlights on the hillside that appeared to show a slide down toward homes below.
Los Angeles Fire Department spokesman Erik Scott said debris flow was affecting three homes, and no injuries were reported. LAFD was called to the scene at 5:30 p.m.
The response comes nearly three weeks after the foundation of an aged home fell down a rain-soaked hillside onto Laurel Canyon Boulevard below.
The roadway, a crucial connector between West Hollywood and the San Fernando Valley, was closed for several days. That incident occurred only about a half-mile from Monday’s debris flow.

Boy Scouts to Open Membership to Transgender Children
The Boy Scouts of America says it will begin accepting members based on the gender indicated on their applications, opening the door for transgender children to become scouts.
Previously, the organization deferred to an individual’s birth certificate to determine eligibility for programs.
“However, that approach is no longer sufficient as communities and state laws are interpreting gender identity differently, and these laws vary widely from state to state,” Scouts spokeswoman Effie Delimarkos said in a statement.
